The AI industry was to be worth 150 billion yuan by 2020, 400 billion by 2025, and 1 trillion by 2030.
From a legal perspective, the AIDP presents a singular characteristic that distinguishes it from Western regulatory frameworks: it integrates industrial policy, national security strategy, and AI governance ethics into a single instrument. In the European ordering, this integration is distributed across at least three separate instruments—the AI Act, the AI Liability Directive, and the Commission's ethics guidelines. The Ministry of Science and Technology (MOST) and the Ministry of Industry and Information Technology (MIIT) are the two central governmental actors in AIDP execution. The EU AI Act operates from the premise that the state regulates and the market innovates, with ex ante conformity assessment mechanisms for high-risk systems. The Chinese model partially inverts this logic: the state sets strategic objectives and delegates to selected private companies both innovation and a portion of sectoral governance. The consequence is greater deployment speed but a significantly reduced separation between commercial interest and regulatory function.
It is not incidental that several of these companies—SenseTime, Hikvision, Megvii—were subsequently placed on the U.S. Department of Commerce's Entity List for their role in surveillance of ethnic minorities in Xinjiang. The NDRC groups these into three components: communications network infrastructure, new technology infrastructure, and computational power infrastructure.
The regulatory-legal relevance of this framework lies in its logic of anticipatory investment. Expected 2020 investments exceeded $300 billion, with exponential growth projections through 2025. In the AI segment alone, the monograph records a jump from $1.32 billion in 2020 to $13.5 billion in 2025. These figures allow us to contextualize why Europe has needed to respond with instruments such as Horizon Europe, the Digital Compass 2030, or the AI Gigafactory Initiative: the asymmetry in public investment in enabling capabilities is structural, not cyclical.

The contrast with the European model is instructive. The EU lacks a structural equivalent to this state-coordinated policy for AI education. The AI Act imposes digital literacy obligations on high-risk system operators, but not a coordinated educational architecture among member states aimed at mass production of specialized talent. Scientific Professional Associations as State-Market-Academia Integration Nodes

The legal singularity of these associations lies in their dual nature: formally they are private or quasi-private entities registered under the China Association for Science and Technology (CAST), but they operate with a strategic orientation that aligns them unambiguously with CCP priorities. The CCF's main webpage, reproduced in the monograph, features a direct link to Party Building activities, with the text: "Publicize and implement Xi Jinping thought." This is not an anecdotal exception—it is the structural rule.
From a comparative law perspective, this configuration differs radically from the European model of standardization bodies such as CEN, CENELEC, or ETSI, which operate with formal independence from national governments under principles of openness, transparency, and consensus. The participation of Chinese companies in these European bodies—and in ISO/IEC—raises serious questions about whether Chinese SPAs use these forums as vectors for strategic technology transfer and normative influence. COVID-19 as Ecosystem Stress Test: Speed, Coordination, and Democratic Cost

Baidu deployed over one hundred autonomous vehicles using the Apollo system for disinfection and logistics. iFlyTek's AI voice assistant was capable of screening up to 800,000 people per day for coronavirus symptoms.
The operational efficiency of this response is beyond dispute. But the monograph—with the analytical sobriety that characterizes its approach—does not evade the democratic cost. The health code was not merely a health tool: it was a permanent geolocation system linked to national identity documents, deployed without informed consent, and maintained active long after China declared the pandemic under control. The CAICT itself documented widespread privacy violations—dissemination on WeChat and Weibo of names, photos, employers, home addresses, and ID numbers—that the Cybersecurity Administration of China attempted to limit through a February 4, 2020 notice.
From a GDPR perspective, none of these processing activities would have passed the lawfulness test under Article 6, the data minimization principles of Article 5(1)(c), or—in the context of facial recognition and geolocation—the conditions of Article 9 for special category data. What the monograph illustrates, without stating it explicitly, is that the Chinese ecosystem's deployment speed is functionally dependent on the absence of the guarantees that the European legal order treats as non-negotiable.
This tension is the core of the global regulatory debate on AI: the systemic efficiency of authoritarian models versus the democratic legitimacy of rights-based models. The EU AI Act has chosen the latter unequivocally, with the speed cost that entails.
The Sino-U.S. Competition: SWOT Analysis and Global Regulatory Implications
The monograph's final chapter synthesizes four institutional assessments—the Center for Data Innovation, the Stanford AI Index 2019, Tortoise Media, and Frost & Sullivan—converging on a shared diagnosis: the United States leads globally in AI, and China is a rapidly accelerating second. The identified weaknesses are equally revealing: difficulty attracting and retaining top-tier talent, dependence on imported semiconductors—the bottleneck most cited in subsequent specialized literature—reliance on U.S. open-source platforms such as GitHub, a metrics-driven industrial model prone to prioritizing quantity over quality, and low workforce diversity in AI.
China's strengths are precisely the competitive vulnerabilities of the European model: mass adoption, unrestricted access to data at scale, concentrated public investment, and rapid deployment capacity. While China builds its ecosystem with a first-mover logic, Europe builds its own with a rights-guarantor logic. The risk—which the EU AI Act attempts to mitigate through the concept of "responsible AI leadership"—is that regulatory rigor translates into a structural competitive disadvantage against ecosystems that externalize the cost of fundamental rights.
The AI Act's response to this dilemma is normative but does not resolve the underlying economic problem. The mandatory conformity assessment for high-risk systems, the human oversight requirements of Article 14, the transparency standards of Article 13, and the registration obligations of Article 71 create regulatory friction that less rights-protective models do not bear. This friction can be absorbed if the EU succeeds in making its standards the global reference—the Brussels Effect—or it can crystallize into a structural competitive disadvantage if third-country markets prefer solutions without those constraints.

Three conclusions merit particular attention from legal practitioners and regulators.
First, the deployment speed of the Chinese ecosystem is structurally incompatible with the guarantee standards the AI Act enshrines. The cost of fundamental rights is real and must be acknowledged openly in the regulatory debate, rather than obscured by the rhetoric of "responsible leadership." Regulators who design compliance frameworks without acknowledging this speed differential risk producing standards that are formally rigorous but competitively isolating.
Second, the competition for international AI standards—at ISO/IEC, ITU, and UNESCO—is a normative battleground in which the presence of Chinese SPAs is not neutral. Western legal practitioners and standards experts need active participation and influence strategies in these bodies. Regulatory engagement cannot stop at domestic or European borders.
Third, the asymmetry in specialized AI talent formation is not solvable through regulation alone. It requires coordinated educational investment at the European level that the current regulatory framework does not contemplate. Law firms, compliance departments, and regulatory agencies that fail to invest in AI-specialized legal talent now will face a structural capacity deficit as the AI Act's full enforcement calendar unfolds.
China's AI ecosystem is, in sum, the primary empirical argument for understanding why European AI regulation cannot be solely an exercise in internal legal engineering. It is also—and perhaps above all—a response to a global strategic competition whose rules no single legal text can write alone.
